LEGAL NOTICE
TOWN OF CHESTER TOWN BOARD RESOLUTION TO CONVEY REAL PROPERTY
SUBJECT TO PERMISSIVE REFERENDUM

NOTICE IS HEREBY GIVEN that at a meeting held on the 31st day of January, 2025, the Town Board of the Town of Chester, Orange County, New York, duly adopted a resolution entitled, RESOLUTION AUTHORIZING APPLICATION FOR LOT LINE IMPROVEMENT AND CONVEYANCE OF REAL PROPERTY BETWEEN THE TOWN OF CHESTER AND WINDRIDGE HOMEOWNERS SOCIETY, an abstract of which follows, which Resolution was adopted subject to a permissive referendum pursuant to Section 64(2) and Article 7 of the Town Law of the State of New York.

Abstract: The purpose and effect of said resolution was to (1) determine that a portion of SBL 33-1-3 is no longer required for use by the Town; (2) authorize the application on behalf of the Town of Chester to the Town of Chester Planning Board for a lot line improvement; (3) authorize the conveyance of 0.86 acres of land in exchange for present and future maintenance costs associated with maintaining the Lily Pond Dam, valued at approximately $ 343,200 dollars, subject to the terms of the resolution.

Said Resolution shall not take effect until thirty (30) days after the date of its adoption or until approved by the affirmative vote of a majority of the qualified electors of the Town voting on such proposition, if within thirty (30) days after the adoption of this Resolution, there be filed with the Town Clerk of the Town a petition signed, and acknowledged or proved, or authenticated by electors of the Town qualified to vote upon a proposition to raise and expend money, in number equal to at least five per centum of the total vote cast for governor in the Town at the last general election held for the election of State

officers, but which shall not be less than one hundred in a town of the first class nor less than twenty-five in a town of the second class, protesting against this Resolution and requesting that it be submitted to the qualified electors of the Town, for their approval or disapproval.
